WildScot Photography Workshop Terms & Conditions for Workshops & Guiding Services
Effective Date: 1 March 2026
These Terms and Conditions apply to all bookings made with WildScot Photography by Michael Cook. This includes workshops and guiding services in Scotland. By booking directly or via any third-party platform (including Humanitix), you agree to these terms.
Nothing in these Terms affects your statutory rights under UK consumer law.
1. Definitions
For the purposes of these Terms:
- “Workshops” refers to guided photography experiences of single or multi-day duration, as listed on our workshop page.
- “Guiding Services” refers to guided photography or nature-based trips. These can include photography, nature, or wider general or cultural experiences. The itineraries may involve single or multi-day journeys.
2. General Terms (Apply to All Bookings)
2.1 Bookings
2.1.1 Bookings can be made directly with us or through third-party platforms like Humanitix.
2.1.2 A booking is confirmed only after we get payment. This can be a full or partial payment, depending on timing, and we issue a booking confirmation.
2.1.3 It is your responsibility to check all booking details carefully and inform us promptly of any errors.
2.2 Participant Responsibility
2.2.1 Participants must inform us at the time of booking of any access requirements. They should also tell us of any medical conditions or mobility restrictions that affect participation.
2.2.2 You should assume a reasonable amount of walking is required, including uneven or natural terrain, unless otherwise stated.
2.2.3 You are responsible for ensuring you are fit to take part in outdoor activities.
2.2.4 You are responsible for your own equipment, clothing, and personal belongings at all times.
2.3 Safety
2.3.1 Wildlife is unpredictable and must be treated with caution at all times.
2.3.2 You must follow all safety instructions given by your guide.
2.3.3 Participation is at your own risk.
2.3.4 We hold public liability insurance appropriate for our activities.
2.4 Liability
2.4.1 Nothing in these Terms limits liability for death or personal injury caused by negligence.
2.4.2 We are not liable for:
• Loss or damage to personal equipment
• Indirect or consequential losses
• Injuries caused by failure to follow instructions or inherent risks of outdoor activity
2.5 Weather and Conditions
2.5.1 All experiences take place outdoors in natural environments in Scotland.
2.5.2 Weather, lighting, and wildlife conditions can’t be guaranteed.
2.5.3 We adjust locations or plans due to conditions to offer the best possible experience.
2.5.4 No refunds are given for weather or wildlife sightings if the workshop proceeds (unless stated otherwise in writing). This does not affect your statutory rights.
2.6 Marketing and Photography
2.6.1 All images taken by participants stay their property.
2.6.2 All images taken by WildScot Photography stay our property unless otherwise agreed.
2.6.3 We will only use photographs for marketing purposes where you have given explicit consent. You can withdraw consent at any time by notifying us in writing.
2.6.4 We encourage tagging and sharing WildScot Photography on social media.
2.7 Data Protection
2.7.1 We collect only the information necessary to manage bookings.
2.7.2 Information is not shared except where needed to process bookings or follow legal obligations.
2.7.3 We run a newsletter which you can subscribe to or unsubscribe from at any time.
2.8 Third-Party Bookings
2.8.1 Bookings made via third-party platforms are under their own terms and fees.
2.8.2 In the case of conflict, these Terms apply to the experience itself.
3. Workshops and Short Guiding Services (Specific Terms)
These terms apply to all workshops and guiding services of 3 days or less (short guiding services).
3.1 Payment
3.1.1 A 25% deposit is required at booking.
3.1.2 The remaining 75% balance is due no later than 30 days before the start date.
3.1.3 For bookings made within 30 days of the start date, full payment is required at the time of booking.
3.2 Cancellations by You
3.2.1 Cancellations must be made in writing.
3.2.2 Refunds:
• More than 30 days before event begins: 100% refund
• 30 days or less: no refund
3.2.3 Platform booking fees (e.g. Humanitix) may be non-refundable.
3.2.4 Transfers to other bookings may be offered at our discretion.
3.3 Cancellations by Us
3.3.1 We may cancel or reschedule workshops and short-term guiding services due to weather, safety, sickness, or minimum numbers.
3.3.2 Minimum numbers decisions are normally made 14 days before the event.
3.3.3 If we cancel, you can choose:
• Full refund, or
• Transfer to another date
3.3.4 We are not liable for any extra costs you incur, including travel or accommodation.
4. Long Guiding Services (Specific Terms)
These terms apply to all guiding services of more than 3 days duration (long guiding service).
4.1 Payment
4.1.1 A non-refundable 25% deposit is required at booking.
4.1.2 The remaining 75% balance is due no later than 30 days before the start date.
4.2 Cancellations by You
4.2.1 If you cancel a long duration guiding service, all payments made are non-refundable. This is because these are reserved, limited-capacity experiences and reflect loss of opportunity to fill your booking.
4.2.2 At our discretion, we will offer a full or partial refund or transfer. This will occur if we can replace your booking with one of equivalent value.
4.3 Cancellations by Us
4.3.1 We may cancel guiding services due to weather, safety, sickness, or any reason beyond our control.
4.3.2 If we cancel, you can choose:
• Full refund, or
• Transfer to another date
4.3.3 We are not liable for any extra costs you incur, including travel or accommodation.
4.3.4 All itineraries for multi-day guiding services are subject to change. This may happen when circumstances beyond our control intervene. These include, but are not limited to, weather, travel restrictions, ferry cancellations, or safety considerations. Where possible we will consult with you before finalising changes to itineraries.
4.4 Additional Costs
4.4.1 Accommodation, transport, and other third-party services are not included unless stated in the booking confirmation.
4.4.2 If we help book these services, you must make full payment within 7 days. This is required once we ask for it.
5. Governing Law and Force Majeure (Apply to all bookings)
5.1 Governing Law
5.1.1 These Terms are governed by the laws of Scotland.
5.1.2 Disputes are subject to the exclusive jurisdiction of Scottish courts.
5.2 Events beyond our control (Force Majeure)
We are not responsible for changes, delays, or cancellations caused by events outside our reasonable control. These include (force majeure) extreme weather, natural disasters, travel disruption, government restrictions, illness, or safety risks. In these situations, we will do our best to offer fair and reasonable alternatives. This can include rescheduling or transferring your booking, depending on the circumstances. Refunds will not normally be paid for changes to itineraries outside of our control. Travel insurance is recommended for this reason.
5.3 Changes to Terms & Conditions
5.3.1 We reserve the right to change these Terms & Conditions at any time. The terms & conditions in place at the date of booking will always apply.
